(CNN) — A New Jersey court ruled Thursday that a Trump surrogate’s phone at the center of a civil lawsuit was the subject of a valid search warrant and ordered the Trump campaign to return it to the lawyer who brought the action.

Mike Lindell, a New Jersey real estate developer whose name began popping up in Trump campaign politics soon after the billionaire businessman’s presidential win early Tuesday morning, was the subject of a criminal warrant by the FBI that was executed at his Trump-linked bed-and-breakfast in Montclair, New Jersey, at the end of September.

The FBI seized the phone, and a magistrate judge signed off on a search warrant that allowed agents to look at any number of the phone’s contacts and data, and ordered Lindell to turn over all the text messages. Lindell did not do so.

Lindell’s attorney, Robert Silverman, had petitioned the court to allow the phone to go back to his office, but on Thursday Judge Gregory Friedman of the Superior Court of New Jersey unanimously rejected the petition and ordered the phone be returned to his lawyer.

The court, which said its ruling was made without prejudice to the FBI’s ability to continue the investigation, is considering whether to hold a trial on the alleged illegal search and seizure.
